MD 41 & MD 42 License Registration Services in India: Who Needs It and How to Apply

Every device that reaches a hospital shelf passes through more hands than just the manufacturers. Somewhere between the port and the patient, a distributor stocks it, a wholesaler moves it, and a retailer sells it. At least one of those businesses needs a registration that has nothing to do with manufacturing or importing. Most find that out during an inspection, not before one.

This registration gets lost in the shuffle more than almost any other CDSCO requirement. It isn’t obscure. It sits where import, distribution, and retail responsibilities overlap, and everyone assumes it’s someone else’s job to hold it.

Let’s go through what MD-41 and MD-42 are, who needs this registration, and where traders and distributors get tripped up.

What MD-41 and MD-42 Actually Cover

MD-42 is the registration certificate that allows a business to sell, stock, exhibit, offer for sale, or distribute medical devices, including in vitro diagnostic devices. You apply on Form MD-41 to your State Licensing Authority, and the certificate is granted on Form MD-42. It is commonly called a wholesale or distribution license, and it applies to the sale and distribution side of the supply chain.

It is separate from the license that brings a device into India (Form MD-14 to MD-15) and from a manufacturing license (Form MD-3 to MD-5). MD-41 and MD-42 cover the downstream businesses that stock, distribute, and sell devices once they are in the country, including devices sourced from overseas and passed along a distribution chain.

However, you write it (MD 41 license, MD 42 license, MD 41 registration, MD 42 registration, or MD 42 registration online), it’s the same process described on this page. The phrasing varies depending on where you’re searching from.

Is Your Business Covered by MD-41 and MD-42?

You likely need MD-42 registration if your business does any of the following with medical devices, including IVDs:

    • Wholesaling or trading. You buy devices and sell them on to retailers, hospitals, clinics, or other businesses.
    • Stocking or distributing for others. You hold devices in a warehouse or move them through a distribution chain, even if you never imported them yourself.
    • Selling to end users. You run a retail shop, pharmacy, or store that sells or exhibits devices commercially.

It doesn’t matter who imported the device. Your supplier’s import license doesn’t cover your own stocking and selling. MD-41/MD-42 is a separate registration, held in your own name for your own premises.

Manufacturers and importers are in a different position. The requirement targets businesses that sell without holding a license under the Rules. If you already hold a manufacturing or import license, confirm with your State Licensing Authority how it applies to your sales activity.

A simple test: if your business sits anywhere between “the device arrived in India” and “the device reached the person using it”, and you stock or distribute it along the way, MD-42 is very likely the registration you need. It is not the import license, and it is not a manufacturing license.

    The Legal Basis

The Medical Device Rules, 2017 set out the framework. The requirement for a registration certificate to sell or distribute devices was introduced by the Medical Devices (Fifth Amendment) Rules, 2022, notified on 30 September 2022. Applications go to the State Licensing Authority in the state where your premises are located. Medical devices are regulated as “drugs” under the Drugs and Cosmetics Act, 1940, so trading without the required registration is dealt with under the same enforcement framework as unlicensed drug trading.

MD-41 and MD-42, Step by Step

Step 1: Confirm you need MD-42. Check that your business role is selling, stocking, or distributing devices, not manufacturing or importing, which follow separate CDSCO tracks.

Step 2: Prepare your premises and documents. Your storage facility needs adequate space and suitable storage conditions for the devices you handle, with records for stock movement.

Step 3: File Form MD-41 with your State Licensing Authority. This is how MD 42 registration online usually works: you file through the online system your state uses and pay the prescribed fee. Procedures can differ by state, so confirm the process for yours.

Step 4: Verification and inspection. The authority reviews your documents, and many states inspect the premises to confirm that storage matches what you declared.

Step 5: Receive Form MD-42. Once your application clears review, your registration certificate is granted for the licensed premises.

    Documents You’ll Typically Need

Requirements vary a little by state, but for most MD-41 applications, keep these ready:

    • Certificate of Incorporation or business registration documents
    • Proof of premises: ownership document, rent agreement, or lease deed
    • Details of your storage facility, including space and storage conditions
    • Details of technical staff responsible for the premises, where required
    • Identity proof of the business owner or authorised signatory
    • Undertaking or declaration of compliance with applicable requirements
    • Site layout or floor plan, where requested

A gap in premises documentation is what most often holds up MD-41 applications. Reviewers want to see that your storage conditions match what you’ve described.

    After You’re Registered

    • Display the certificate at a prominent place on the premises.
    • Keep suitable storage. Maintain adequate space and proper storage conditions at all times.
    • Maintain an inspection book in Form MD-43, so the inspecting officer can record observations.
    • Pay the retention fee. MD-42 stays valid in perpetuity if the retention fee is paid within five years of issue. It can be suspended or cancelled if conditions are breached.

What Happens If You Trade Without This Registration

Trading in medical devices without the required registration exposes you to the penalty provisions of the Drugs and Cosmetics Act, 1940, including Section 27. Inspectors can inspect your premises, seize unregistered stock, and halt trading while the matter is resolved. For a distribution business, that can mean an entire warehouse of stock frozen until it is cleared.

    Frequently Asked Questions

What’s the difference between Form MD-41 and Form MD-42?

MD-41 is the application you file with your State Licensing Authority. MD-42 is the registration certificate granted once your application clears review.

Is MD-42 the same as the “CDSCO drug import license”?

No. People sometimes use that phrase for MD-42, but it is not an import license. The import license is held by the importer and is granted on Form MD-15 after an application on Form MD-14. MD-42 covers selling and distributing devices.

Do I need MD-42 if I only resell devices someone else imported?

Yes. If your business stocks, distributes, or sells devices commercially, it applies to you whether or not you imported the device.

    Do retailers need MD-42?

Yes. Anyone who sells, stocks, or exhibits devices commercially is covered, not only wholesalers.

Can I complete MD 42 registration online?

Applications are generally filed through the online system your state uses. Procedures can differ by state, so confirm the process with your State Licensing Authority.

How long is an MD-42 valid?

It stays valid in perpetuity if the retention fee is paid within five years of issue, unless it is suspended or cancelled.

What happens if I’ve been distributing devices without MD-42?

You’re exposed to the Act’s penalty provisions. The practical fix is to register promptly rather than wait for an inspection to force the issue.

Does every business that touches a device need this registration?

No. Manufacturers and importers follow their own license tracks. MD-41/MD-42 applies to businesses that sell, stock, or distribute without holding such a license.

Can EXIM ADVISORY help determine whether I need MD-41/MD-42?

Yes. Confirming whether your role needs MD-42 or a different CDSCO track is usually the first thing we sort out.
